Capstone gets court approval

Capstone Infrastructure (TSE:CSE) said on Monday the Supreme Court of British Columbia has issued a final order approving plans for the power generation mutual fund's takeover by Irving Infrastructure.

Irving, a subsidiary of iCON Infrastructure Partners III LP, a fund advised by UK-based iCON Infrastructure LLP, is to acquire all issued and outstanding common shares of Capstone and Class B exchangeable units of Capstone's subsidiary MPT LTC Holding LP for $4.90 cash per share or unit.

The deal was previously approved by Capstone securityholders at special meetings held earlier this month. As reported by Proactive Investors, debenture holders approved the deal last Thursday.

Capstone expects the deal to be completed by early May, following fulfilment of certain closing conditions and receipt of regulatory approvals.
